Racket Pulse is an exclusive booking management system tailored specifically for racket sports. It provides a seamless solution for managing court reservations, scheduling coaching sessions, and handling membership plans.

The ownership of this website, https://racketpulse.com/, (hereinafter referred to as Website) and of the Booking App (hereinafter referred to as App) is held by: Racket Pulse LTD. PTE., with NIF: 202504987C and registered in: 160 Robinson Road, 068914, Singapore; and whose contact details are: admin@racketpulse.com

This document regulates the conditions governing the use of this Website and the App and the purchase or acquisition of services on it (hereinafter, Conditions). For the purposes of these legal conditions, it is understood that the activity that RACKET PULSE develops through the Website or the App includes:

• Commercialization and reservation of padel courts or tennis courts or any other sports such as Pickleball or badminton.

In addition, RACKET PULSE may act solely as an intermediary between Users and sports clubs, and therefore shall not be considered a provider of the sports services themselves. The contractual relationship for the use of the courts or facilities will always be between the User and the specific club.

2. ACCEPTANCE OF TERMS

By using RACKET PULSE, either as a User or a Merchant, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the platform.

In addition to reading these Conditions, before accessing, browsing and/or using this website, the User must have read the cookies policy, and RACKET PULSE privacy policy on data protection. By using this Website or making and/or requesting the acquisition of a product and/or service through it, the User agrees to be bound by these Terms and all of the above. If the User does not agree with all of the above, the User must not use this Website.

Likewise, the User is informed that these Conditions may be modified. The User is responsible for consulting them each time they access, browse and/or use the Website, as those that are in force at the time the acquisition of products and/or services is requested will be applicable.

RACKET PULSE offers various services to users, aimed at improving their sports experience. These services include:

• Reservations: users can book courts for different sports directly through the RACKET PULSE application. Instantly check and book available courts, ensuring users can quickly secure their preferred time slots without delays.
• Open matches: users can join open matches, which are matches available to the public in which anyone can participate
• Tournaments: users can participate in organized tournaments, competing against others in structured competitions.

We expressly reserve the right to change these Terms of Use from time to time without notice to You. You acknowledge and agree that it is Your responsibility to review this Site and these Terms of Use from time to time and to familiarize Yourself with any modifications. Your continued Use of this Site after such modifications will constitute acknowledgement of the modified Terms of Use and agreement to abide and be bound by the modified Terms of use.

3. INTELLECTUAL PROPERTY

The RACKET PULSE name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of RACKET PULSE or its affiliates or licensors. Users must not use such marks without the prior written permission of RACKET PULSE. All content, features, and functionality on the Website and App, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of RACKET PULSE, its licensors, or other content suppliers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Website and App solely for personal, non-commercial purposes in accordance with these Terms.

Users may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Website or App.

4. THE USER

The User assumes responsibility for the correct use of the Website and the App. This responsibility will extend to:

• Making use of this Website and the App only to make legally valid inquiries and purchases.
• Not making any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it could be canceled and the relevant authorities informed.
• Providing true and legal contact information, for example, email address, and/or other information as the name or the phone number.

The User declares to be over 18 years of age and to have legal capacity to enter into contracts through this Website and the App.

The Website and the App are primarily aimed at Users residing in Asia Pacific region. PADEL RACKET does not guarantee that the Website or the App complies with the laws of other countries, either in whole or in part.

5. RESPONSIBILITIES:

Court Conditions

RACKET PULSE is not responsible for issues related to the condition of the court where a reservation or match is played. This includes matters such as maintenance, quality, or safety concerns of the facility.

While we aim to support our users through customer service channels, please note the following:

• Reporting Issues: Users should address any problems related to court conditions directly with the club or facility management.
• Support Limitations: RACKET PULSE has no direct authority over court maintenance or safety. Resolution of issues related to court conditions must be handled by club or facility management.
• Accuracy of Information: Only the club is responsible for the information provided on RACKET PULSE. If a user finds the information to be incorrect, they must complain and request a refund directly from the club. This information includes, but is not limited to: photographs, logos, court specifications and characteristics, contact information, location, listed amenities, operating hours, and any other descriptive information provided by the club.
• Booking Verification: Users are encouraged to verify booking details directly with the club before arriving, especially for important matches or events.
• Weather Conditions: Racquet Pulse is not responsible for weather-related cancellations or court conditions. Users should check the club's weather policy and contact the club directly for such issues.
• Equipment: Users are responsible for bringing their own equipment unless otherwise stated by the club. Racket Pulse is not responsible for the availability or condition of any equipment provided by the club.
• Club Policies: Each club may have its own specific policies regarding court use, cancellations, and refunds. Users are advised to familiarize themselves with these policies when booking through RACKET PULSE.
• Dispute Resolution: In case of any disputes regarding court conditions or information accuracy, users should first attempt to resolve the issue with the club. RACKET PULSE may assist in facilitating communication but is not responsible for the final resolution.

These guidelines are in place to ensure clear understanding of responsibilities among RACKET PULSE, the clubs, and the users. They aim to minimize misunderstandings and provide a framework for addressing potential issues that may arise during the use of our service.

6. TERMINATION OF USE:

You agree that we may, in our sole discretion, terminate or suspend your access to all or part of the Site with or without notice and for any reason, including, without limitation, breach of these Terms of Use. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating Your relationship and may be referred to appropriate law enforcement authorities.

Upon termination or suspension, regardless of the reasons therefore, Your right to use the services available on this Site immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or this Site. We shall not be liable to You or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by Us in connection with such termination or suspension.

The Service, or any feature or part thereof, may not be available in all languages or in all countries and RACKET PULSE makes no representation that the Service, or any feature or part thereof, is appropriate or available for use in any particular location. To the extent you choose to access and use the Service, you do so at your own initiative and are responsible for compliance with any applicable laws.

7. FORCE MAJEURE

RACKET PULSE shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

8. PRICES AND PAYMENT

To make a purchase, Users should follow these steps:

1. Select the desired service (court reservations, public matches, classes, private classes, courses, tournaments, or leagues) offered by clubs on RACKET PULSE.
2. Review the selected service details.
3. Proceed to the checkout process.
4. Choose the preferred payment method from those offered by the specific club.
5. Confirm and complete the payment.

Users can modify their selection at any point before final confirmation.

Upon completing a purchase, the User will receive an email confirming that RACKET PULSE has received their order or purchase request. This confirmation will also be available in the User's personal account space on both the website and mobile application.

By subscribing to the service for more storage and additional features, RACKET will automatically charge the recurring fee for the plan you choose, including any applicable taxes, to your associated payment method. You can change your subscription at any time by upgrading or downgrading your plan in the section of Settings.

YOU ARE RESPONSIBLE FOR THE TIMELY PAYMENT OF ALL FEES AND FOR PROVIDING APPLE WITH VALID CREDIT CARD OR PAYMENT ACCOUNT DETAILS FOR PAYMENT OF ALL FEES. If RACKET PULSE is unable to successfully charge your credit card or payment account for fees due, RACKET PULSE reserves the right to stop the service provided.

The accepted payment methods may vary depending on the club but could include payment at the club, club wallet, Google Pay, PayPal, credit card, debit card, and other local payment methods depending on the country.

Cancellation and Refund Policy

In the Business to Consumer model if the cancellation is made at least 24 hours in advance, the refund will be processed using the original payment method.

Any cancellations made within less than 24 hours of the scheduled service are non-refundable

In the Business to Business model, no refund will be applied.

Non-Cancelable and Non-Refundable Provisions

Certain services may be expressly designated as non-cancelable and non-refundable (e.g., promotional offers, tournaments, leagues, or packages). These provisions will be clearly stated at the time of purchase, and by proceeding, the User acknowledges and accepts them.

9. PRIVACY POLICY

The processing of users' personal data will be governed by the Platform's Privacy Policy, which is accessible at all times within the application.

RACKET Pulse and its partners and licensors may provide certain features or services that rely upon device-based location information using GPS (or similar technology, where available) and crowdsourced Wi-Fi access points and cell tower locations. To provide such features or services, where available, RACKET PULSE and its partners and licensors must collect, use, transmit, process and maintain your location data, including but not limited to the geographic location of your device and information related to your Account and any devices registered thereunder.

10. GOVERNING LAW

Access, navigation and/or use of this Website or App and contracts for the purchase of products through it will be governed by Singapore legislation.

Any controversy, problem or disagreement that arises or is related to the access, navigation and/or use of the Website or App, or with the interpretation and execution of these Conditions, or with the purchase agreements between Playtomic and the User, will be submitted to the non-exclusive jurisdiction of the Singapore courts and tribunals.
